2. Definitions

• Service — yacht registration in the Polish REJA24 register, including document translation and certificate delivery
• Client — the individual or legal entity purchasing the Service
• REJA24 — Polish Electronic Register of Watercraft, administered by Urząd Morski w Szczecinie
• Provisional Certificate — digital document issued by REJA24 authorising immediate navigation under Polish flag
• Definitive Certificate — physical card issued by REJA24 upon completion of the process

3. Scope of service

The Service includes:

• Preparation and submission of the registration application to REJA24
• Certified translation of required documents (from Portuguese/English to Polish)
• Communication with Urząd Morski w Szczecinie throughout the process
• Delivery of the Provisional Certificate by email in digital format
• Delivery of the Definitive Certificate by registered post to the Client's address
• Support in Portuguese throughout the process

The Service does not include: legal advice, technical yacht inspection, insurance services, or any service not listed above.

4. Pricing and payment

All prices are in euros. Prices include all applicable taxes. Payment is made at the time of ordering via Stripe. Prices are fixed with no hidden fees, except for additional services expressly agreed in writing.

5. Delivery timeline

• Provisional Certificate: issued within 7 business days from receipt of all complete, correct documents
• Definitive Certificate: issued by REJA24 within up to 30 business days; delivered by registered post
• The timeline starts when the Client provides all requested documents, not from the payment date

6. Client obligations

• Provide truthful, complete and up-to-date documents (ID, proof of ownership, yacht technical data)
• Respond to information requests within 5 business days
• Communicate any relevant changes immediately
• Be the legitimate owner or duly authorised to register the yacht

7. Refund guarantee

The guarantee does not apply in the following cases:

• Registration was refused by REJA24 due to reasons attributable to the Client (false documents, yacht already registered elsewhere without prior deletion, yacht subject to seizure or dispute)
• Client did not provide requested documents within 30 days of payment
• Client withdrew after translation had begun

Refund requests must be submitted by email to polaca@registoiate.pt. Refunds are processed within 14 business days via Stripe.

8. Liability

VIVIBOAT sp. z o.o. is liable for the correct performance of the contracted Service. Our liability is limited to the amount paid by the Client. We are not liable for delays caused by REJA24, false information provided by the Client, postal delivery issues after dispatch, or decisions of port authorities in third countries.

9. Right of withdrawal (consumers)

9.1. A consumer has a statutory right to withdraw from the contract within 14 days of its conclusion, without giving any reason.

9.2. By placing the order, the client expressly requests that the service begin immediately, before the end of the 14-day period.

9.3. If the client withdraws after the service has begun but before it has been fully performed, the client shall pay an amount proportional to the services provided up to the moment of withdrawal, including translation costs and administrative fees already incurred (minimum €50).

9.4. The right of withdrawal expires upon full performance of the service, i.e. upon issuance of the registration document in the REJA24 registry. The client expressly acknowledges this loss of the right when placing the order.

9.5. To withdraw, it is sufficient to send an unequivocal statement to our contact e-mail, e.g.: "I hereby withdraw from the service contract for the registration of the vessel [name/hull number], ordered on [date]."

9.6. Any refund due shall be made within 14 days using the same payment method used for the order.

10. Governing law and jurisdiction

These Terms are governed by Polish law. Any dispute shall be submitted to the courts of Gdańsk, Poland, without prejudice to the consumer's right to bring proceedings before the courts of their place of domicile under applicable EU law.

Alternative dispute resolution: consumers may use alternative dispute resolution (ADR) entities. For VIVIBOAT sp. z o.o., the competent entity in Poland is the Regional Trade Inspection in Gdańsk (Wojewódzki Inspektorat Inspekcji Handlowej w Gdańsku). Information on ADR in Poland: https://polubowne.uokik.gov.pl. In Portugal, consumers may contact Portuguese ADR entities, including CNIACC (https://www.cniacc.pt).

11. Changes to these terms

VIVIBOAT sp. z o.o. reserves the right to update these Terms. Changes take effect 14 days after publication. Services already contracted before the change are subject to the Terms in force at the date of order.
